The Terms and Conditions below govern your contract with Tibet Discovery (Full Name: Chengdu Bamboo International Tours Co., Ltd.). In these Terms and Conditions, “We”, “us” and “our” means Tibet Discovery, Tibetdiscovery.com and Chengdu Bamboo International Tours Co., Ltd, and 'you' and 'your' means all persons named on the booking, or any of them as the context requires (including anyone who is added or substituted at a later date). Please read carefully as all our tour and travel services are subject to these Terms and Conditions which also set out our respective rights, obligations and disclaimer. Booking a tour or travel service provided by us means you have agreed to all these terms and conditions. These terms and conditions only apply to tour and travel services you book with us in China. We reserve the right to modify or rescind the terms and conditions in whole, or in part at any time with or without notice.

Our Website
www.tibetdsicovery.com is the business website of Tibet Discovery (Company Name: Chengdu Bamboo International Tours Co., Itd.). The description of the tours, services and travel guide we provide on our website are all for reference only. If you want to book any one of the tour or travel service, you need to ask us to confirm the final details. Our tour itineraries are sample itineraries and for your reference only. The final itinerary will be specified with details in the confirmation letter we send to you before your tour starting. The travel guide and articles about attractions, weather, transportation, etc. on our website are created to help you plan China tour easily. They are for your reference only.
We have always been trying our best to ensure all the contents are accurate and updated. However, we are not responsible for any loss or damage or inconvenience arising as a consequence of any use of or the inability to use any information on our website. It is your own risk to rely on any information on our website. We don’t take responsibility for the contents of external website we may link to.
We collect necessary personal information to support your booking process with Tibet Discovery. To provide you the best experience, we may use website analytic tools to collect your cookie, browser, referring/exit pages, devices, etc. We will only use your personal information as set out in our Privacy Policy.
Tour/Service Price
Most of the prices on our website/quotation are by US Dollar (USD) and Chinese Yuan (CNY). They are not the final prices until the Confirmation Letter is sent. USD prices are subject to change according to the fluctuation of USD currency.
Please note we are not responsible for any charges levied by third parties or financial institutions and payable by you as a result of credit card or other payment transactions.
Payment Requirements
Deposit
After reaching an agreement on a tour or travel service with you, we will ask you to pay a deposit to secure your booking. Your travel consultant will inform you the deposit amount which usually differs by tour and service types.
Once we receiving your deposit, we will send you tour or travel service Confirmation Letter via Email. For example, if you book a tour with us, our Confirmation Letter sent to you via Email will contain details of your itinerary, included services and payment requirements. Please check the Confirmation Letter’s details carefully, especially your travel dates, nationality, passport number, name, date of birth, gender, etc. as soon as you receive it and contact us immediately if you think any details are incorrect. We regret we cannot accept any liability if we are not notified of any inaccuracies in any document timely. We will do our best to rectify any errors notified to us after this, but you must meet any costs involved in doing so.
Balance
Payment of the balance of the price for any products or services booked is due 30 days before the departure date of the first product or service included in the applicable booking, which will be specified on the booking Confirmation Letter. If we do not receive all payments due in full and on time, we will remind you that payment is due before treating your booking as cancelled by you. In the event that further time for payment is agreed at your request but payment is still not received, you must pay the cancellation fee based on the date we treat your booking as cancelled by you.
When full payment is required?
Certain products or services, such as tickets booking, hotel booking, etc., may require you to make full payment at the time of booking. We will advise you of any such requirements prior to confirmation of the applicable booking.
If a booking is made less than 30 days before the departure date of the first product included in the applicable booking, then the full amount must be paid at the time of booking.
Our Available Payment Methods
We offer a variety of payment methods to make it easier for you to pay for our tour and services. You can choose from PayPal, Wire Transfer, Alipay, WeChat Pay, cash, and more. It is highly recommended to seek the help of your travel consultant when making payment, as they can assist you in selecting the most appropriate payment method based on the real-time exchange rate, your location and other factors. Change Tour/Travel Service
Both parties of you and us have the option to mutually agree upon any changes to the terms mentioned in the Confirmation Letter. Such amendments need to be made in writing and signed by both parties (or any other forms agreed upon and confirmed by both parties). The Party requesting the revision will bear any additional costs and losses incurred by the other party due to the changes. In case the cost is reduced, we will refund the reduced amount to you, provided that all the necessary requirements are met.
However, please note that any changes made are subject to the terms and conditions outlined in our "Terms and Condition" which we may update from time to time.
Changed by You
Before your booking is confirmed, alterations to your tour or travel services are happily processed free of charge, because providing the best tour possible for you is our goal. However, if you want to change your tour or any travel service in the Confirmation Letter after the tour or travel service has come into existence, we cannot guarantee that such changes can be made. Where a change can be made, we will charge for any additional costs incurred including extra cost of new services (items), cancellation charges that may be incurred for sectors or services cancelled, etc.
We will do our best to implement any changes to your arrangements you request once they have commenced, but we cannot guarantee this will be possible. In the event of such amendments being made, you will be liable for any cancellation charges that may be applied in respect of the services originally booked, and for the costs involved in booking the revised arrangements as well as for the cost of the new arrangements themselves. It is unlikely that refunds will be paid to clients who do not complete a tour/holiday. However, where we ourselves are able to obtain a refund from hotels or principals for services not used, we will pass this on to you.
Changed by Us
Changes to confirmed tour or service sometimes have to be made. Most changes will be insignificant, and we have the right to make these. Where an insignificant change is made before departure, we will notify you in writing. No compensation is payable for insignificant changes.
Occasionally, we may be constrained by any Force Majeure or Unexpected Event beyond our control to make a significant alteration to any of the main characteristics of the tour/services which form part of your confirmed booking or to any special requirements. We will provide you notification in written or phone call as well as the alteration plan or substitute package. Where a change can be made, we will charge for any additional costs incurred including extra cost of new services (items), cancellation charges that may be incurred for sectors or services cancelled, etc. If you do not want to accept the alteration(s) or any substitute package offered in our notification, we will refund the refundable payment according to our cancelation policy. No compensation will be payable or other liability accepted where a change results from Force Majeure and Unexpected Event.
Cancel Tour/Travel Service
Cancelled by You
We would be understandable that you may have to cancel your booking or part of your booking out of necessity. You may cancel your confirmed booking at any time prior to departure. Where you wish to do so, please submit your cancellation in written form by email or fax with your signature. If you wish to cancel your booking, you will be charged a Cancellation Fee calculated as a percentage of the total holiday cost as shown below. The percentage payable depends on the date your email notification is acknowledged by us and tour/service type.
In calculating cancellation fees, we have taken account of the costs incurred by us in arranging and booking your tour or travel service, as well as any cost savings and the generation of income from other bookings which may be able to offset our loss from cancelled services. In the event of cancellation of part of your booking, the cancellation charge payable by you will comprise any direct costs and charges we incur as a result of such cancellation, our reasonable administration costs of dealing with the cancellation arrangements, plus any payment which relates to the cancelled part of the holiday. We will try our best to mitigate these costs to the extent we can reasonably do so.
In the event that Force Majeure or Unexpected Event occurs in the place of destination of your holiday or its immediate vicinity and significantly affect the performance of the contracted arrangements or the carriage of passengers to that destination, according to relevant Chinese laws you will be entitled to cancel prior to departure without Cancellation Fee and receive the refundable monies except for our service charge and any previously incurred cost. Where applicable, you must notify us of your wish to cancel for this reason in written. Providing we are in agreement that you are entitled to do so in accordance with this clause, we will send you a Cancellation Letter to confirm the cancellation. Any refund then due will be paid in accordance accordingly. We will notify you as soon as practicable in the event of this situation occurring.
Calculation of cancellation fees
The cancellation fee will be capped at the total cost of your holiday and will never exceed this amount. Usually the cancellation fee will be calculated as follows except specified cases (check after below form):

Notices for Special Cases:
1. Specifically we may be able to charge the Cancellation Fees according to your cancellation dates, tour and service types. Please consult your travel advisor for details;
2. The Cancellation Fees for some items, such as Yangtze River Cruise, Club Med Vacation follow the Cancellation Policies of the service providers. You can check details with your travel consultant.
3. The Cancellation Fee for tours with more than 10 people varies from common tours. Please check details with your travel consultant.
Cancelled by Us
Occasionally, it may be necessary to cancel confirmed holiday arrangements. We have the right to cancel your tour or service in the event we are prevented from performing your confirmed arrangements as a result of Force Majeure or Unexpected Event and we notify you of this as soon as reasonably possible. According to the relevant Chinese laws (regulations) and our cancellation policy, where we have to cancel your tour or service in these circumstances, we will return you the refundable monies except for any previously incurred cost and service charge but we will have no further or other liability to you including in respect of compensation or any costs or expenses you incur or have incurred. We will of course endeavor to offer you comparable alternative arrangements where possible which you may choose to book in place of those cancelled.
We also have the right to cancel your booking of tour/travel service if you fail to make payment in accordance with our booking terms.
Travel Document
A valid passport with a minimum of 6 months’ validity from the date of your departure to China is the requirement of travel to and around China. In most cases you are also required to have a valid Chinese visa to travel to and around China unless you are making a transit and qualified for the visa-free rules. Some places may need extra permits. You can consult your travel advisor.
Please note documents preparation is the sole responsibility of yours, though your travel consultant may assist you advice on applying for the necessary travel documents upon your request. Tibet Discovery accepts no responsibility or liability whatsoever for your failure to obtain appropriate documentation. If you are unable to travel because your passport is not valid for the destination or you are not able to obtain necessary visa, cancellation charges will apply.
Insurance
Never travel without suitable insurance, the unexpected can always happen. It is your responsibility to ensure you are adequately covered by insurance for all elements of your trip. Please read your policy and take it on holiday with you. Please be aware that advice against non-essential international travel issued by governments may have an impact on your travel insurance. You must check the policy terms prior to purchasing your insurance.
We strongly recommend that you and all members of your party are adequately insured, providing financial protection against unforeseen circumstances. Cover should include medical expenses, as well as repatriation, in the event of accident or illness. In addition, we strongly recommend that you have cover for personal belongings, delay at your outward or homeward point of departure, personal liability, overseas legal expenses and cancellation. If you are undertaking any sports or adventurous activities on your trip, including trekking, you should also make sure that your policy covers these. Please also ensure you read the policy conditions and exclusions.
Once you have a travel insurance policy in place, please let your specialist know who your insurance company is and your policy number. Having this information enables us to support you should an emergency situation arise.
Luggage Allowance
Airlines and trains of both domestic and international companies have regulations on the luggage allowance. The allowed weight and size are limited. These regulations are usually different. It is your responsibility to check the detailed regulations of the luggage allowance from the flight, train or other transport companies before your boarding. Failure to follow the luggage allowance regulations may result in refusal by airport staff to load suitcases onto the aircraft, train, ship and other transport tools.
Healthy Requirements
You are responsible for assessing whether a tour is suitable for you. You should consult your physician to confirm your fitness for travel and participation in any planned activities. You should seek your physician’s advice on vaccinations and medical precautions. We do not provide medical advice. It is your responsibility to assess the risks and requirements of each aspect of the tour based on your own unique circumstances, limitations, fitness level and medical requirements.
Travel in China may involve visiting remote or developing regions, where medical care may not be easily accessible and medical facilities may not meet the standards of those found in your home country. The condition of medical facilities in the areas you may visit on your tour varies and we make no representations and gives no warranties in relation to the availability or standard of medical facilities in those regions.
You must provide any required medical information reasonably if needed. If you have any pre-existing medical conditions which may impact your ability to travel, participate in a tour, travel to remote areas without access to medical facilities or may adversely affect the experience of others on your tour, you must return a Medical Form, signed by a licensed and practicing physician to us prior to or at the time of final payment for the applicable booking. You agree to complete the Medical Form honestly and to disclose all relevant medical information accurately and fully. We reserves the right to deny you permission to travel or participate in any aspect of a tour at any time and at your own risk and expense where we determine that your physical or mental condition renders you unfit for travel or you represent a danger to yourself or others.
In the event that you do not complete the required Medical Form or provide medical information reasonably required by us for any reason by the deadline indicated above, we reserves the right to cancel your booking and all applicable cancellation fees will apply.
Pregnancy is considered a medical condition and must be disclosed to us at the time of booking. We may refuse to carry women who are over 24 weeks pregnant. We may refuse to carry anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged.
Complaints
Should you have any complaints about any aspect of your holiday arrangements, you must inform our local representative or tour leader immediately of the arrangements concerned. Problems can most easily be dealt with on the spot. Please note, if you do not report a problem or complaint straight away which, if it had been reported at the time it occurred, could have been quickly resolved, we cannot accept any liability in respect of that problem or complaint. It is sensible to expect a client travelling in the developing world to be reasonably resourceful if things go wrong. If the issue cannot be resolved locally you can contact us on our emergency telephone service. The number will be found in your confirmation letter. In the unlikely event that an acceptable solution cannot be found, you should then write to us within 7 days of your return with full details of your complaint. If you fail to follow this simple complaints procedure, we are unlikely to be in a position to properly investigate the matter and may have been deprived of the opportunity to remedy it during your holiday.
Assistance
during your holiday In the event you end up in difficulty (of any sort) during your tour, we will provide you with appropriate assistance as soon as reasonably possible including by the provision of appropriate information on health services, local authorities and consular assistance and by assisting you to make distance communications and to find alternative travel arrangements as may be applicable. Where you are in difficulty as a result of your negligence, we may charge you a reasonable fee for this assistance which will not exceed the costs we actually incur.
Force Majeure/Unexpected Event
Except as expressly set out in these booking conditions, we cannot accept liability or pay any compensation or other sums where the performance or prompt performance of our contractual obligations is prevented or affected, or you otherwise suffer any loss or damage as a result of Force Majeure/Unexpected Event. In these booking conditions, Force Majeure/Unexpected Event means a situation which is beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Such situations are likely to include, whether actual or threatened, acts of God, technical or maintenance problems with transport, changes of schedules or operational decisions of air carriers, acts of war or terrorism, governmental acts or omissions, changes in laws or regulations, government or governing authority restrictions, exchange or market rulings, extreme market volumes or volatility, suspension of trading (whether declared or undeclared), breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, explosion, fires, natural catastrophes such as storms, floods, earthquake, etc., pandemic, quarantine, riots, work stoppages, strikes, embargoes, adverse weather or events of nature. Upon an occurrence of an event of force majeure, we shall discuss further procedures with you and use reasonable efforts to provide help.
Excursions and activities
Please note that we do not provide or arrange excursions or activities other than those listed in your itinerary and forming part of the arrangements booked and paid for prior to your departure date. Our local representatives or guides may put you in touch with local organizers of excursions or activities if you request but we can have no liability for such excursions or activities. Your contract for them will be with a local company providing the services and not with us and they are not operated, supervised, controlled or endorsed by us in any way.
Our liability & responsibility
It is our responsibility to make sure that all parts of the holiday we have agreed to arrange, perform or provide as part of our contract with you are arranged, performed or provided with reasonable skill and care. This means that, subject to these booking conditions, we will accept responsibility if, for example, your contracted holiday arrangements are not provided as promised or prove deficient as a result of the failure of ourselves, our employees, agents or suppliers to use reasonable skill and care in making, performing or providing, as applicable, your contracted holiday arrangements. Please note, it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us.
In addition, we will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work we had asked them to do (for agents and suppliers). We will not be responsible for any injury, illness, death, loss (including loss of enjoyment or possessions), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following: - (a) the fault of the person(s) affected; or (b) the fault of a third party not connected with the provision of your holiday which we could not have predicted or avoided; or (c) unavoidable and extraordinary circumstances as defined in Force Majeure/Unexpected Event section. In addition, we will not be responsible where you do not enjoy your holiday or suffer any problems because of a reason you did not tell us about when you booked your holiday.
Please note: we cannot accept responsibility for any services which do not form part of our Confirmation Letter. This includes, for example, any additional services or facilities which your hotel or any other supplier agrees to provide for you where the services or facilities are not advertised by us as forming part of your holiday and we have not agreed to arrange them as part of our tour or service and any excursion or activities you purchase during your holiday which does not form part of the arrangements we have contracted to provided.
Your Responsibility
You undertake to behave with propriety and in such a manner as not to cause or be likely to cause material distress, danger or upset to others and/or any third party or damage to property. If we, our employees, agents or suppliers consider you do not behave accordingly, we reserve the right to terminate your contract and neither we nor the providers of any of the services in question will have any further contractual obligations to you either in respect of covering any expenses, paying any compensation or refunds, or arranging for your return home.
When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. If the actual cost of the loss or damage exceeds the amount paid where estimated, you must pay the difference once known. If the actual cost is less than the amount paid, the difference will be refunded. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party's full legal costs) as a result of your actions. You must ensure that all your travel documents, passports, visas, vaccination certificates and currency are in order and valid for travel. All costs incurred in obtaining such documentation must be paid by you. We regret we cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to obtain and carry all required documentation or to otherwise comply with all applicable requirements.
You must check entry and other official requirements as well as any requirements applicable on your trip at the time of booking and in good time before and close to departure. Passport, visa and other requirements are likely to change and restrictions may be imposed (which could be at no or very short notice prior to departure) as a result of government measures. You must also keep up to date with this information while you are away. If failure to be in possession of any necessary travel or other documents or to otherwise comply with applicable requirements results in fines, surcharges, other financial penalty, expenses or costs being incurred by us, you will be responsible for reimbursing us accordingly. If you are unable to travel as a result of failure or inability to comply with any health related or other requirements, cancellation charges will apply as referred to in section. The name on your airline tickets must be exactly the name that appears on your passport. Please note that if you believe we or your travel agent have stated orally that a particular facility or service should be available but this is not referred to in the brochure or elsewhere in writing by us, you must make reference to it on the booking form so that we may confirm it to you when accepting your booking.
